Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and SpotYaBuddy (“SpotYaBuddy”, “we”, “us” or “our”) governing your access to and use of the SpotYaBuddy website, mobile applications and related services (the “Service”). If you don’t agree with these Terms, please don’t use the Service.

1. Who can use SpotYaBuddy

You must be 18 years or older to create an account or use the Service. The Service is intended for adults seeking training and activity partners. By creating an account, you represent and warrant that you are at least 18, that the information you provide is accurate, and that you will keep it up to date.

You may not use the Service if we have previously removed you or banned you, or if doing so would breach any law that applies to you.

2. Your account

You are responsible for your account and for keeping your login details secure. You must not share your account, create an account for anyone else, or impersonate another person. Tell us promptly at hello@spotyabuddy.com if you suspect any unauthorised use of your account.

3. What SpotYaBuddy is — and isn’t

SpotYaBuddy helps people discover and connect with others nearby who share their activities and training goals. We are an introductions platform only. We do not screen, background-check or verify the identity, conduct or intentions of members beyond the limited measures described in the Service, and we are not responsible for the conduct of any member, whether online or offline.

4. Acceptable use

When using SpotYaBuddy, you agree that you will not:

• harass, threaten, abuse, stalk, bully, defame or intimidate any other person;
• post or share content that is unlawful, hateful, sexually explicit, violent, discriminatory or otherwise objectionable;
• use the Service for dating, romantic or sexual solicitation — SpotYaBuddy is for finding training and activity partners;
• use the Service for advertising, recruiting, multi-level marketing, coaching sales or any commercial solicitation without our written permission;
• misrepresent who you are, your age, or your reason for being on the Service;
• request or collect other members’ personal or sensitive information for any purpose beyond arranging a mutually agreed activity;
• attempt to access accounts, data or systems you’re not authorised to, or interfere with the Service’s operation or security;
• scrape, copy or harvest content or member data using automated means.

We may investigate and take action — including removing content, suspending or terminating accounts, and reporting to authorities — for any breach of these Terms.

5. Content you post

You retain ownership of the content you submit (your profile details, photos and messages). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content for the purpose of operating and improving the Service. You are responsible for your content and represent that you have the rights to share it and that it doesn’t breach these Terms or anyone else’s rights.

6. Meeting other members — assumption of risk

Meeting people you don’t know carries inherent risk, and you meet other members entirely at your own risk. SpotYaBuddy does not vet members and is not present at, and takes no responsibility for, any interaction or meeting between members. We strongly encourage you to follow our safety guidelines— meet in public places such as the gym or park, tell someone you trust where you’ll be, keep conversations in the app until you’re comfortable, and trust your instincts. To the maximum extent permitted by law, you assume all risk arising from your interactions and meetings with other members.

7. Not health, medical or fitness advice

SpotYaBuddy does not provide medical, health, or professional fitness advice. Content on the Service is for general information only. Always consult a qualified professional before starting or changing any exercise programme, and train within your own limits.

8. Fees and future paid features

SpotYaBuddy is currently free to use. We may introduce optional paid features or subscriptions in the future. If we do, we’ll tell you the price and terms before you’re charged, and paying will always be your choice. Any purchases made through the Apple App Store or Google Play are also subject to those stores’ terms.

9. Suspension and termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if we need to for legal or safety reasons, or if we discontinue the Service. We’ll give you notice where reasonable and lawful to do so.

10. Disclaimers and liability

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we exclude all warranties not expressly stated in these Terms, and we are not liable for any indirect, incidental or consequential loss, or for the acts or omissions of other members.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited to the maximum extent permitted by law.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll let you know through the Service or by email before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state.
